Hammad Ahmed vs Abdul Majeed and Ors

Bench: 2 — Hemant Gupta

In Brief

Hammad Ahmed, appointed Chief Mutawalli of Hamdard Laboratories (India) under a 1948 Wakf Deed, sought restraint against respondents from interfering with Hamdard's operations and requested exclusive authority to operate the institution's bank accounts. A 2015 resolution had arranged for one member each from two trustee groups to jointly sign for banking operations. The Supreme Court corrected an inadvertent reference to 'management' in its prior judgment, clarifying it meant 'banking operations' only. The Court dismissed the appeal, holding that the appellant was not granted exclusive banking rights and the joint signing arrangement should continue, as no relief regarding sole signatory access was granted at the earlier stage."
