NOIDA allottees who exercised their option to continue hotel plot allotments at an enhanced premium of Rs. 70,000/- per sq. metre filed contempt petitions alleging NOIDA's refusal to execute supplementary lease deeds despite partial payments. Rather than impose contempt sanctions, the Supreme Court offered two options: (1) pay all outstanding dues by 31.12.2019 for supplementary deed execution; or (2) surrender plots for NOIDA re-auction, with refunds calculated on a formula ensuring NOIDA receives minimum Rs. 1,05,000/- per sq. metre. Refunds of premium deposits and 7% interest are payable only if re-sale price exceeds this minimum. The Court emphasized public interest in productive land utilization and balanced the allottees' and authority's competing interests to resolve a decade-long stalemate."
