A dispute arose over the allotment of a large gala (shop) in the Mumbai Agricultural Produce Marketing Committee's wholesale market at Vashi. The Supreme Court held that Habibullah Farhatullah was not entitled to the gala merely because his father's booking amount was transferred to his name, as this violated the Daud Committee's strict eligibility norms. The partnership firm M/s Ramchandra Vitthal Dongre could not rely on individual partners' historical payments. Instead, the Court found four eligible claimants—including M/s Hande Wavare & Co. and Ganpat Sabaji Shinde, who marginally fell short of norms—and ordered the gala be allotted by sealed tender to the highest bidder at an upset price of Rs. 55,00,000/-, ensuring fair market value and better revenue for APMC.
