A dispute arose over allotment of a large commercial gala (shop) in Mumbai's agricultural market following a previous order cancelling an earlier allotment. The Supreme Court held that respondent Habibullah Farhatullah is not entitled to the gala because he never personally booked or paid for it; transferring his father's booking was contrary to established eligibility norms. The partnership firm's claim was also rejected as it was formed after the cut-off date. The Court upheld that eligible claimants marginally short of norms (including the original appellant) should compete via sealed tenders at the market-determined price of Rs. 55 lakh, rather than lottery, ensuring fairness and revenue for the agricultural market committee.
