Hari Chand vs Union of India and Anr

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Landowners of village Aali challenged a land acquisition compensation award of Rs. 12,000 per bigha, seeking enhancement based on higher compensation awarded for nearby villages. The Supreme Court upheld the High Court's refusal to enhance compensation. The Court found that higher awards for adjacent villages were justified by evidence of superior land characteristics or different comparable properties, and were not applicable to village Aali. The claimants' witness admitted in cross-examination that developed land in nearby Jasola was distant from the acquired land. Without credible evidence of similarity and with adjacent villages receiving the same rate, the Court held the award fair and reasonable, dismissing the appeals.
