Hari Chand vs Union of India and Anr

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The landowners of village Aali sought enhanced compensation for acquired land, claiming it should match higher rates awarded to adjoining villages under the same notification. The Supreme Court upheld the High Court's rejection of this claim. The Court found that the landowners failed to establish genuine similarity or comparability between their land and higher-valued parcels in other villages. Witness evidence showed that the supposedly comparable land in village Jasola was at considerable distance from the acquired land and far from main roads. The awarded rate of Rs. 12,000 per bigha was found justified based on comparable nearby villages and was upheld.
