Hari Shankar Shukla vs State of U.P

Bench: 2 — R.F. Nariman

In Brief

In July 1992, a land dispute in village Mamkhor escalated into violence. A man was shot and killed; three accused were charged. The trial court acquitted all three, citing inconsistent witness accounts and medical evidence. The High Court reversed this, finding that all three eye-witnesses (including two injured) consistently identified the appellant as the sole shooter. The Supreme Court upheld the conviction for culpable homicide and attempted murder but reduced the sentence from ten to six years imprisonment, plus a fine of Rs. 7,000, on grounds of delay and time already served.
