Hari Singh vs State of Himachal Pradesh

Bench: 3 — Ranjan Gogoi

In Brief

A driver was acquitted by the trial court of charges under Sections 279, 337 and 304A IPC after evidence showed his tempo (truck) suffered a tyre burst, causing loss of control and an accident. The High Court reversed the acquittal, claiming a mechanical defect was ruled out in another report. The Supreme Court found the High Court had confused reports relating to different vehicles and that the trial court's reasoned acquittal, supported by the Motor Mechanic's evidence, was not devoid of reasoning. The Court restored the acquittal and allowed the appeal.
