Harshita Bhasin vs State of West Bengal & Ors

Bench: 3 — D.Y. Chandrachud

In Brief

Harshita Bhasin and Mukul Bhasin were embroiled in a matrimonial dispute with custody of two minor children (aged 8 and 5). The Calcutta High Court ordered fortnightly visits in Kolkata, requiring the children to travel from Delhi/Noida at 3:30 am and return late at night before school. The father sought modification, arguing the arrangement was stressful and harmful to the children's physical and mental well-being. The Supreme Court, with the consent of both parties, modified the order to split visits monthly—the children travel to Kolkata once monthly, while the mother visits Delhi once monthly, with the father bearing travel and hotel costs. This arrangement better serves the children's welfare while preserving the mother's visitation rights."
