In Brief

The Haryana Staff Selection Commission had rejected candidates for Post Graduate Teacher positions on the ground that their B.Ed. final results had not been officially declared before the application deadline, despite universities having issued provisional/confidential results to them beforehand. The Supreme Court upheld earlier High Court decisions holding such candidates eligible, as the universities themselves had verified and released these provisional results before the cut-off date. The Court clarified and modified its earlier order directing 90 candidates' appointment: only candidates who had approached the Courts could benefit, merit must be respected in the recasted list, and back-wages would not be paid though appointment would relate back to the original selection date. No deliberate disobedience was found given documented delays from administrative causes.
