Hindustan Petroleum Corporation appealed against an order directing reinstatement of a respondent employee with service benefits but without back wages. Through negotiated settlement, the Supreme Court set aside the original order and instead directed the corporation to accommodate the respondent in a Class IV vacancy in Pune with protected pay and service benefits (excluding back wages). The respondent was required to report for duty within two weeks, with provision for consideration in Class IV vacancies in Sholapur if they arose. The appeal was disposed with the question of law kept open.
