A man accused of falsely marrying a woman (thereby committing cheating and sexual assault under IPC Sections 493 and 376(2)(n)) had his anticipatory bail application rejected by the Gujarat High Court. The Supreme Court allowed his appeal and granted bail after the charge-sheet was filed, without deciding the case on merits. The Court ordered that upon arrest, he would be released on bail subject to trial court conditions and continued cooperation with investigation. The State retained the right to seek bail cancellation if conditions were breached.
