Holeyappa and Ors vs Patel Ganapathi and Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Holeyappa and others were convicted under the Indian Penal Code for causing injuries to Patel Ganapathi and companions in a group fight in 2006. Both sides had been injured and had already undergone sentences in counter-cases. The Supreme Court held that in a mutual group fight, it is difficult to attribute specific intention to cause particular injuries to individual accused. Although maintaining the conviction, the Court set aside the imprisonment sentence and upheld an order directing the appellants to pay Rs. 1,00,000 as compensation to the injured respondents, considering the parties had resumed normal relations."
