Holeyappa and Ors vs Patel Ganapathi and Ors

Bench: 2 — 2

In Brief

Appellants were convicted for causing injuries to respondents in a 2006 mutual fight between two related groups, resulting in injuries on both sides. The High Court had ordered the appellants to deposit Rs. 1 lakh as a condition for exemption from surrender. The Supreme Court set aside the imprisonment sentence, finding it difficult to attribute specific intent to cause particular injuries in a reciprocal fight. The Court held that the Rs. 1 lakh deposited would be paid to the respondents as compensation, considering the parties had resumed normal relations and the incident's mutual nature.
