Supreme Court of India 2017-01-11 remanded

Hoshiar Singh (D) Thr. Lrs & Ors vs State of Punjab & Ors

Bench: 2 — Kurian

In Brief

Landowners challenged the High Court's dismissal of appeals seeking enhanced compensation for land acquired in 1987 for the Ranjit Sagar Dam project. The appellants had filed applications under Rule 27 CPC to introduce evidence of comparable compensation awarded in Jammu & Kashmir and Himachal Pradesh. The High Court rejected the evidence without formally disposing of the applications. The Supreme Court held that a court cannot dismiss additional evidence without first passing a substantive order on its reception. The judgment was set aside and remanded to the High Court to properly consider the Rule 27 applications and reconsider compensation comparatively."
