ICICI Lombard Insurance challenged a Motor Accident Claims Tribunal's award of compensation and costs to an injured respondent. The High Court had upheld the compensation. The Supreme Court declined to interfere with the compensation award but identified a specific legal question: whether a Motor Accident Claims Tribunal—created under a special statute, not technically a 'Court'—has authority to award costs using procedures meant for ordinary courts under the Constitution and CPC.
