In Brief
The Indian Institute of Information Technology sought to set aside court orders quashing its cancellation of academic appointments. The Board had terminated teachers based on a Status Report they never received, violating natural justice principles. The High Court had quashed this termination and remitted the matter for fresh decision with proper procedure. However, the Institute then took additional unilateral decisions and issued new show-cause notices. The Supreme Court held that the Institute should only have provided the Status Report, allowed two weeks for representation, and conducted a hearing before taking any fresh decision. The Court set aside the subsequent decisions and directed the Institute to follow proper procedure, deeming the teachers to remain in service pending a lawful fresh decision within two months.
