The Supreme Court upheld the refusal, holding that when a management committee appoints teachers against substantive vacancies, it must first notify the vacancy to the statutory Selection Commission and wait for its recommendation or confirm the post has been vacant for two months. Promotion must be attempted before direct recruitment. Since the management bypassed these mandatory procedural requirements and the State had imposed a recruitment ban, the appointment was illegal and the State could not be forced to pay salary.
