In Brief
In this 2017 judgment, the Supreme Court recalled its earlier order dated 21 October 2016 in a writ petition challenging the designation process for senior advocates under the Advocates Act, 1961. The Court found that a large section of non-designated lawyers (approximately 95%) had not been adequately heard on the issue. Additionally, the constitutional validity of the statutory provisions governing senior advocate designation was simultaneously challenged in the Delhi High Court. The Court transferred the high court petition to itself and adjourned both matters for fuller hearing together in February 2017, prioritizing procedural fairness and complete consideration of the grave constitutional issues involved.
