In this civil appeal, the Indore Municipal Corporation challenged a High Court decision affirming that municipal authorities possess the power to compound (regularize) unauthorized construction rather than mandatorily ordering its demolition. The Supreme Court upheld the High Court's judgment. The Court held that before ordering demolition, the Commissioner must first evaluate whether unauthorized construction can be compounded within legal limits through a joint inspection with the building owner. The Commissioner then has discretion to take appropriate action under law. The appeal was dismissed.
