The Supreme Court upheld the High Court's judgment. The Court held that before ordering demolition, the Commissioner must first evaluate whether unauthorized construction can be compounded within legal limits through a joint inspection with the building owner. The Commissioner then has discretion to take appropriate action under law. The appeal was dismissed.
