Appellants claiming to be pre-partition tenants on land in Telangana challenged an auction notice issued by the State. They had filed writ petitions against land allotment and sought patta (tenant rights) as pre-partition occupants. The High Court allowed the State's writ petitions. The Supreme Court remitted the matter back to the High Court, holding that appellants had not properly raised their pre-partition tenancy claims in the writ petitions. The Court clarified that land transferred to the State for displaced persons' settlement must be used for that purpose first, and appellants could pursue other competent forums to establish their tenant rights.
