The Supreme Court quashed the High Court's direction regarding promotion, finding it unsustainable in law. However, the Court recognized the respondent's entitlement to equal salary as that paid to Section Officers during the period he worked in that capacity on an officiating or charged basis. The appellant was directed to pay such salary if not already paid.
