The respondent, an Electrician appointed in 1974, sought promotion to Section Officer and Executive Officer under the Time-Bound Promotion Scheme (TBPS). The High Court Division Bench had allowed his appeal and directed promotion with arrears. The Supreme Court reversed this, holding that employees in special categories like Electricians were explicitly excluded from TBPS advancement beyond the next grade by the 1984 settlement. Subsequent 1988 and 1991 settlements maintained this exclusion without repealing it. However, for the period the respondent worked as Section Officer on temporary charge, he remains entitled to that post's salary if unpaid.
