Jagdish Chander Malik vs Manmohan Juneja

Bench: 2 — Kurian

In Brief

The appellant filed a contempt petition against the Registrar of Companies (ROC) for allegedly failing to implement an order dated 11 January 2013. The High Court dismissed the contempt petition, finding it misconceived: the Court had only granted the appellant liberty to approach the ROC's office at his own convenience; he had failed to attend on the fixed date and time; and no clear court order was disobeyed. The Supreme Court upheld the dismissal but, in the interests of justice, granted the appellant a further two-month period to approach the ROC, directing compliance with the original order without delay.
