Jagpal Singh Thakur vs State of Madhya Pradesh & Ors

Bench: 2 — Kurian

In Brief

Jagpal Singh Thakur was denied regularization as a Forest Guard because he married before turning 21 years old. The State of Madhya Pradesh relied on this age restriction. However, the appellant demonstrated that four other candidates—Narayan Prasad Raikwar, Babulal Carpenter, Raj Kishore Tiwari, and Bhagatram Raikwar—had been granted relaxation despite similar circumstances. The Supreme Court found the difference between the appellant's marriage date and the age-21 threshold was merely days, and mandated equal treatment. It set aside the High Court's judgment and directed the authority to regularize the appellant as Forest Guard with full consequential benefits within three months."
