Jan Sahyog Sewa Samiti vs State of Uttarakhand and Ors. Etc

Bench: 2 — Sanjay Kumar, Alok Aradhe

In Brief

A batch of special leave petitions challenged High Court orders in public interest litigation directing removal of all encroachments from alleged railway land near Haldwani Railway Station affecting approximately 50,000 people. Petitioners contended they were not individually noticed or heard before eviction orders, and some claimed valid legal possession through government leases or auction allotments. The Supreme Court did not adjudicate the main controversy, instead directing affected parties to move the High Court individually for recall/modification, to be examined by a Division Bench. The execution of High Court orders was stayed for three months to allow such applications and ensure affected parties received individual hearings on their possession claims.
