Supreme Court of India 2019-09-05 dismissed

Jyothir R vs Sunisha N.S. & Ors

Bench: 2 — Not specified

In Brief

The appellant, a candidate for admission to an MBBS course in Kerala under the Sports Quota, challenged the categorization of another candidate (Respondent No. 5) in the Individual Sports category. The Kerala High Court initially allowed his petition, but the Division Bench reversed it. The Supreme Court affirmed the Division Bench's order, holding that the Sports Council's attempt to re-categorize a candidate after the Final List was published was unjustified and could not be entertained at such a belated stage. Allowing such intervention would require re-doing the entire admission process. The Court ruled that the Final Rank List of 28.06.2019 must remain the basis for admission and dismissed the appeals.
