Two employees of Mayo College, Ajmer—a prestigious private unaided educational institution—were dismissed in 2000 after leading protests demanding payment of bonus. Although the Management had not complied with statutory requirements for dismissal (specifically, obtaining written consent from the Director of Education as mandated by the Rajasthan Non-Government Educational Institutions Act, 1989), the Court held that the employees' actions caused grave institutional damage. The Court held that reinstatement was not appropriate in a contractual private institution and awarded monetary compensation instead. The Court enhanced the High Court's award from five years' salary to eight years' salary plus provident fund and retiral dues, totalling Rs. 25 lakhs for Kailash Singh and Rs. 18 lakhs for Jeffry Jobard."
