Kale (Dead) Rep. Thr. LRs vs Union of India

Bench: 2 — Abhay Manohar Sapre

In Brief

Landowners appealed against a High Court order dismissing their claim for additional compensation in land acquisition proceedings. They claimed 45 Bigha 3 Biswas of land was acquired by the State, but compensation was paid only for 36 Bigha 12 Biswas. The Supreme Court upheld the High Court and Reference Court findings that only 36 Bigha 3 Biswas was actually acquired. The appellants failed to produce documentary evidence supporting their claim of the larger extent. The Court held compensation is payable only for land actually acquired and dismissed the appeal.
