In Brief
The appellants sought occupancy rights over land under the Karnataka Land Reforms Act, 1961. The respondents argued that prior civil proceedings had settled the land dispute finally and those findings were binding. The Supreme Court held that judgments in concluded civil proceedings are indeed binding on parties to subsequent proceedings involving the same land and parties. However, the Court found the applicant's claim for occupancy rights was meritorious. Accordingly, the appeal was allowed and occupancy rights were granted to the appellant, as the findings from the prior civil suit did not preclude the grant of occupancy rights where the legal conditions were satisfied.
