Karan Singh Tyagi vs State of U.P. & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Karan Singh Tyagi was accused of bigamy and related offences for marrying while already married. A supplementary charge-sheet added a rape charge (Section 376 IPC). The Supreme Court found inherent improbability in the complainant's version of the rape allegation: she discovered the prior marriage in 2014 but had married the accused in 2009, and delayed filing the complaint by a year. The Court allowed the appeal and quashed the rape charge while permitting trial to proceed on the bigamy and fraud charges. The Court distinguished between the credible allegations of marital deception and the implausible rape complaint.
