Karan Singh Tyagi vs State of U.P. & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellant was charged with bigamy (marrying twice without dissolving the first marriage) and rape under the Indian Penal Code. A supplementary charge-sheet was filed alleging rape. The appellant challenged it before the High Court, which refused. The Supreme Court found inherent improbability in the rape allegation because the complainant discovered the earlier marriage in 2014 but was married to the appellant since 2009, and filed the complaint only after one year of such knowledge. The Court quashed the rape charge-sheet while allowing trials to continue under bigamy and fraud-related offences where prima facie case existed."
