Kavita Chandrakant Lakhani vs State of Maharashtra & Anr

Bench: 2 — R.K. Agrawal

In Brief

A woman filed a criminal complaint against her ex-partner, alleging he forcibly took her to his house, assaulted and molested her on 6-7 September 2003. Initially charged under multiple IPC sections including 366 (abduction with intent to compel marriage or force illicit intercourse), the accused sought discharge. The Supreme Court held that Section 366 does not apply merely because a woman was forcibly abducted; the prosecution must prove the specific intent to compel marriage or force intercourse. Since the accused and complainant were in a pre-existing relationship and her molestation allegation was added months later, the Court found no evidence of the requisite intent. The discharge was upheld and the appeal dismissed, though the trial on other charges was ordered completed within six months.
