In Brief
The Kerala Public Service Commission challenged a High Court order requiring disclosure of examiner identities under the Right to Information Act. The Supreme Court held that while candidates are entitled to their own answer sheets, tabulation sheets, and marks—as these promote transparency and fairness—examiner names need not be disclosed. The PSC and examiners share a fiduciary principal-agent relationship; disclosing examiner identities could endanger them and compromise future examinations through candidate revenge or illegal influence attempts. The appeals were partly allowed, upholding disclosure of candidate materials while protecting examiner confidentiality.
