The Supreme Court dismissed an appeal challenging a High Court order that rejected an application to dismiss a civil suit under Order 7 Rule 11 of the CPC. The High Court had found that a cause of action was made out by the pleadings. The Court held that a suit cannot be rejected under Order 7 Rule 11 merely based on the pleadings; such rejection is appropriate only where it is manifest that no cause of action exists. The Court directed the trial court to expedite proceedings and dispose of the suit within six months.
