Kundan Lal & Anr vs Kamruddin & Anr

Bench: 2 — R. Banumathi

In Brief

A plaintiff sought vacant possession of a property (120 sq. yards in Khasra No. 270) which he claimed was allotted to him as a tenant by the Punjab Wakf Board at Rs. 50/month from April 1990. The defendants claimed they took possession from one Shivlal under an agreement dated May 1990 and were subsequently recognized as tenants at Rs. 100/month. The Trial Court, First Appellate Court, and High Court all found in favour of the plaintiff. The Supreme Court dismissed the appeal, holding that the defendants were allotted a different survey number (Khasra No. 267) and had no right to the suit property. The concurrent findings of fact by the courts below were upheld, and the defendants were granted six months to vacate.
