The appellant, a medical officer posted at Patna Medical College, challenged his transfer. The High Court had previously (in 2008) held that he was entitled to Associate Professor salary due to his actual utilization as a teacher. The Supreme Court upheld this, finding that although the appellant's formal cadre allocation did not designate him as a teacher, the fact that he had been treated and used as a teacher entitled him to the benefits recognized in the earlier final High Court judgment. The appeal was allowed and the lower court judgments were set aside.
