LEASING (INDIA) PVT. LTD. AND OTHERS vs THE STATE OF WEST BENGAL AND OTHERS

Bench: 2 — Vikram Nath, Rajesh Bindal

In Brief

A man obtained a fraudulent caste certificate claiming Scheduled Tribe status, which he used to challenge his deceased father's land sale decades later. The Court found the claim unsustainable: the father was never registered as Scheduled Tribe, had sold ten acres without objection during his lifetime, and the son himself had sworn affidavits claiming general caste status in 2000. The son could not produce the original certificate and no supporting documents existed in official records. The Court set aside the High Court's judgment allowing a Committee to revisit the fraud and reinstated the cancellation of the caste certificate, dismissing the challenge to the land sale.
