Lord Buddha Educational Society & Anr vs Union of India & Anr

Bench: 3 — <UNKNOWN>

In Brief

Lord Buddha Educational Society challenged the Ministry of Health's 2017 decision refusing to permit MBBS admissions for 2017-18 and 2018-19 and directing the Medical Council of India (MCI) to encash its Rs. 2 crore bank guarantee. The Supreme Court partly allowed the petition, directing MCI to conduct fresh inspections treating the 2017-18 renewal application as one for 2018-19, protect existing students' continued enrolment, ensure fair opportunity to cure deficiencies, and direct the Ministry to decide within one month using a Hearing Committee. The bank guarantee was protected from encashment pending final decision. The petition was disposed with modified relief."
