Lt. Col. S.K. Hari and Another vs State of Uttar Pradesh and Another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A retired Lieutenant Colonel and his elderly father sought to quash criminal charges (dowry harassment, cruelty, misappropriation) filed by the appellant's ex-wife. After a civil divorce was granted in 2006, both parties remarried. By the time the case reached the Supreme Court, the ex-wife claimed unreturned jewelry and personal belongings. The Court found that continuing criminal proceedings served no purpose since both parties had genuinely settled in life. It allowed the appeal conditionally on payment of Rs 7 lakhs by the appellant to his ex-wife in full settlement of all claims, and quashed the charge-sheet and all related criminal proceedings.
