Bitan Sengupta & Anr vs State of West Bengal & Anr

Bench: 2 — <UNKNOWN>

In Brief

In this criminal appeal, husband and wife involved in a dowry-related dispute reached a settlement and executed a memorandum of understanding while the wife's Section 498A conviction appeal was pending. The wife stated in writing that she had no grievances against the husband and sought his acquittal. The parties later obtained mutual divorce on the basis of this settlement. The High Court dismissed the revision petition upholding the conviction. The Supreme Court allowed the appeal and set aside the conviction, holding that in the spirit of matrimonial harmony, courts should accept genuine settlements between spouses and compound dowry-related offences when the complainant has withdrawn grievances.
