Bitan Sengupta & Anr vs State of West Bengal & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellants were convicted under Section 498A IPC (dowry harassment) based on a complaint by their wife. While their appeal was pending, the parties settled their dispute through a Memorandum of Understanding and obtained mutual divorce. The High Court dismissed the revision petition. The Supreme Court allowed the appeal, holding that courts should accept genuine settlements in matrimonial disputes and compound such offences when the injured party has no grievances and both parties undertake not to pursue further litigation, especially where the settlement has been acted upon through mutual divorce."
