M.C. Mehta vs Union of India & Ors. : In Re. : Sealing Issue (Report Nos. 129 and 131 submitted by Monitoring Committee)

Bench: 3 — Madan B. Lokur

In Brief

In this 2018 judgment on an ongoing monitoring matter in a pollution/illegal dairy case, a Member of Parliament allegedly broke a seal placed on an illegal dairy by municipal authorities. The Court found the MP admitted breaking the seal, claimed he did so under mob pressure. The Court strongly deprecated this conduct as contrary to the rule of law and wholly inappropriate for an elected representative. However, it declined to prosecute for contempt. The Court also rejected the MP's subsequent allegations that the Court-appointed Monitoring Committee was running a 'sealing racket,' finding them politically motivated and false. The proceedings were closed, leaving disciplinary action to the political party."
