M.D. Jain vs Bhagyavathi & Ors

Bench: 2 — Kurian

In Brief

The appellant, accused of tampering with court documents in collusion with court staff, sought discharge from contempt proceedings. A CBI investigation (court-monitored) filed a final report finding no material or circumstantial evidence against the appellant and concluding no cognizable offence was committed. The High Court denied discharge, mistakenly believing the CBI inquiry targeted only court staff conduct. The Supreme Court held this was factually incorrect, as the appellant was accused No. 1 in the CBI investigation and was specifically exonerated. The Court set aside the impugned order and remitted the matter for reconsideration in light of the CBI's exoneration.
