M.H. Uma Maheshwari & Ors vs United India Insurance Co. Ltd. & Anr

Bench: 3 — N.V. Ramana, R. Subhash Reddy, Surya Kant

In Brief

The deceased, aged 50 years 3 months, died in a motor vehicle accident caused by negligent driving. The Motor Accidents Claims Tribunal awarded his dependents Rs.65.60 lakhs in compensation using a multiplier of 13 and 30% future prospects. The High Court reduced this to Rs.57.78 lakhs, applying only 15% future prospects while maintaining the multiplier. The Supreme Court held that for a deceased aged 40-50 years with a multiplier of 13, future prospects must be 30%, not 15%. The Court allowed the appeal, restored the Tribunal's award as just and reasonable, and set aside the High Court's reduction.
