The heirs of Ashok Kumar, who died in a 1994 bus accident when alighting from a Chandigarh Transport Undertaking bus, appealed the High Court's compensation award of Rs. 3,98,500. The Supreme Court held the High Court erred by not adding future prospects to the deceased's income computation. Applying National Insurance Company Ltd. v. Pranay Sethi, the Court added 40 per cent for future prospects and recalculated compensation at Rs. 6,41,200, with interest at 9 per cent per annum from petition date. The deduction of one-third for personal expenses was upheld as proper. The appeal was allowed.
