M.K. Kushalappa (father) and his son challenged the High Court's dismissal of a writ petition seeking CBI investigation into the suspicious death of M.K. Ganapathy, a police Deputy Superintendent. The deceased had died shortly before revealing televised allegations of harassment by three high-ranking officials including a former Home Minister. The Supreme Court held that while CBI investigation is not granted merely for asking, exceptional circumstances arise where State investigation lacks credibility. Given that the deceased named the accused officials and the State police recorded it as suicide, the Court allowed the appeal and transferred the investigation to CBI to determine the true nature of the offence.
