Star Wire, an independent biomass power producer commissioned in May 2013, challenged amended renewable energy tariff regulations that denied it the benefit of revised tariff norms during the interim period until the amendments' notification in August 2015. While projects commissioned after 2013-14 received full benefits, Star Wire's project was excluded without intelligible differentia. The High Court dismissed the writ petition with minimal analysis. The Supreme Court held that the High Court failed to adequately examine the discrimination claims and remitted the case for proper reconsideration, emphasizing that regulatory amendments must be challenged and adjudicated through meaningful judicial review on their merits.
