In Brief
A textile manufacturer sought to limit back wages owed to retrenched workers to January 1995 when its factory closed, rather than January 1999 as ordered by a High Court Division Bench. The Supreme Court held that where a Single Judge examined the evidence and found the industry ceased functioning in January 1995, the Division Bench could not substitute a different factual finding without fresh material merely because another view seemed possible. The Court vacated payment of back wages beyond January 1995, upheld closure compensation and retrenchment benefits from the Division Bench order, and partly allowed the appeal.
