Manohar Lal Sharma vs Central Bureau of Investigation & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The petitioner sought directions to investigate Indian offshore bank account holders named in the Panama Papers and to take action against SEBI and capital market participants allegedly involved in financial manipulation. The Court found that the existing Special Investigation Team on black money already had jurisdiction over such matters, and a Multi Agency Group had been constituted to investigate Panama Papers disclosures with reports submitted to the SIT. The Court held that no further directions were necessary as the concerns were adequately addressed through existing institutions, and cautioned that PIL should not interfere with executive governance absent clear abuse or failure.
